Family Educational
Rights & Privacy Act of
1974 (FERPA)
FERPA, commonly known as the Buckley
Amendment, was issued by the Department
of Health, Education and Welfare in the 1976
Federal Register. The regulations were transferred
to the Department of Education when it was
established and codified in Part 99 of Title 34 of
the Code of Federal Regulations.
The purpose of FERPA is to afford certain rights
to students concerning their educational
records. FERPA applies to all schools that receive
funding under most programs administered by
the Secretary of Education. Most postsecondary
institutions, both public and private, generally
receive such funding and must, therefore,
comply with FERPA.
FERPA applies to all education records
maintained by a postsecondary institution, or
by any party acting for the institution, which are
directly related to the student. These include,
but are not limited to, assessment test scores,
academic standing, rosters, class schedule, or
any information that would make the student’s
identification easily traceable. FCC may release
directory information, which includes student’s
name, dates of attendance, and enrollment
status–see the FCC catalog for a complete list.
Students wishing to restrict directory
information or grant additional access must
contact the Welcome Center (in writing) with
their request within two weeks of the start of the
semester. A new form is required each semester.
Contact the Welcome Center for additional
information.
